Hello,
My brother-in-law and sister are both Indian Doctors, having a private practice in INDIA. They would like to apply for visitor's visa.
Any suggestion about the problems they may encounter? Do they have to go on two differrent dates for getting the visa stampped at Chennai?

The chances to get visa is 1% as they know why they come here even though you say that they come here for visiting.The documentation is same as for B2 visa.

With the Oct Visa bulletin now official, Its high time we did some thing like this if not some kind of class action law suit.
We should not let USCIS explain it all way with "Our estimates were just too high...its not our fault you got screwed" :mad: . They need to be made accountable :mad:

I can't find any reference on this forum to E2 investors. We are the skilled, motivated entrepreneurs who come here, invest heavily, employ citizens and have no path to permanent residence. Our children must return to their country of origin at age 21, regardless of how long they have lived here. We ourselves must renew our visas regularly and live in fear of denial.
E2 investors need support in our quest for reform. Is there any room in your organization for us? We will go anywhere and do anything to raise awareness of the injustice of the current immigration laws. The DREAM Act was (thankfully) defeated yet again and should continue to be defeated until it includes all immigrant children, not just illegals.
Those of us who come here legally should be at the top of the list when it comes to reform. Can we band together to make our voice even louder?

....and that is precisely what happened when thousands of "pending demand" GC's were issued in June 2007 and the early hours of July 2nd, just before the fiasco.
Pre-adjudication as a policy started in early 2006 especially at the NSC resulting in tons of "pending demand" cases just before the fiasco.
Coming to the present time, with several receiving RFE's when their PD's are not current, I would suspect that many would en-masse get their GC when DoS moves the dates forward substantially compared to now.

Any PERM case filed before July 25th 2005 was taking long time because of system problems. But this long is a news to me. I wish you good luck and hope that it will get cleared soon.

I was in a kind of similar situation couple of times
1. I had a valid US visa and I was traveling from Cincinnati to New Delhi via Paris on Air France. My flight from Cincinnati got delayed and I missed my connecting flight in Paris. All the passengers that had the green card or US citizenship were allowed to stay in Hotel outside the airport. But, since I am an Indian national and did not have a transit visa, France custom officer told me that I am "illegally" in France. He was nice guy and advised me to stay the night at the airport terminal and board the plane to India next day.
2. My visa on my passport expired and I had the H1 extension papers with me. I was traveling on Air France from Cincinnati to New Delhi and my flight was via Paris. The airline staff at Cincinnati did not allow me to board the plane as I did not have a valid US visa on my passport. I had to drive down to Chicago to get the transit visa.
Bottom line, if you don't have a green card it is better/safe to get a transit visa. France is a tourist friendly country and they process the visa much faster than other embassy provided you have had western country visa before (which in your case you do).

Recent VB fiasco has put many of us in confusion and disappointment, but will not hold us back… Most of us must be now be moving on with what we have to do and try to get the best, we can with what we have and can and try to make things better for us.
We all have different advice from our attorneys; my attorney did not recommend sending the I-485 papers to USCIS now or did not provide any advice regarding to joining the lawsuit being discussed by AILA. Also my paper work is handled by the Immigration Attorney in my company legal department and not any external law firm.
Talked to couple of friends and some told, they still sent the AOS papers knowing it will be send back and some are in same situation like mine. . Created this poll just to get some sample data how many had files I-485

Unlike illegal immigrants, our family, including two teenage girls, followed the legal way to come into the USA. My husband, an IT specialist, was asked to come by a U.S. employer. We are from Holland, where some have had a weak spot for the USA since World War II; we took the step of moving to America in 2001.
After a visa, heaps of paperwork and an extension of the visa after three years � the employer still needs my husband's skills. He also offers his skills to U.S. workers via training. No other experts are available. So, we decided we wanted to stay. Despite legal hurdles, we like it here.
But, for the past year and a half or so, the Department of Labor has stacked applicants in backlog centers to see whether it is true that no U.S. citizen is available for the job. Officials promise a lot, but we are all waiting and waiting.
If the immigration legislation adds some millions of guest workers to that stack, what will happen to us legals?
That's why I was glad to see the commentary �Stingy immigration policy stifles U.S. innovation.� I hope it raises awareness. But couldn't we legal immigrants get the front page for once?

Till now EB2 India has much to cover till 2006 and then it will move fast. Also it seems very few People actually filed for EB2 after 2006 knowing the wait. Though we have aroun 24000 Perm for India (EB2/EB3) combined for 2007. Needless to say that USCIS data is very much required for Predicting Priority dates accurately
One reason to have more Eb2 in 2006 is tiresome wait in EB3. Many people after PERM implementation (May 2005) decided to go for second file in EB2 and hence the more EB2 files in 2006.

I know what you mean... there is nothing to stop us from doing something else totally different from our job description once we become permanent residents.
That's just how the immigration law works... and I think it applies to all nations in the world. You can't say that you want to work as a carpenter when you filed your GC as an IT skilled worker (as an example). Like as previously mentioned, it would make the LCA stage pretty obsolete.
But I think it would be GREAT if we were all allowed to freely change employers (within the same industry of work) without being shackled by employer sponsorship. I am sure that would please everybody, except for the bosses of course.

WD is right that this is a model for groups with specific issues within iv. it is not possible for iv leaders to maintain focus on every issue in the realm of this warped system. as an organization it is only appropriate for iv to focus on the big overarching goal of ending retrogression to benefit all.
however specific groups do have a way to take initiative for their issues within the iv framework. it is necessary though to find leaders, take initiative and build your own momentum with continuous efforts.
iv-physicians is a model for this and it's hopefully continued and eventual success will inspire others.

If you stopped payment on individual checks (My banks charges $30 for each check stoppage) it would have been denied eventhough USCIS tried to cash it (instantly as it is electronic transaction).That you received receipt notices means, the checks went through, and your application is considered properly filed.
If stopped as a batch of checks (it is free of charge with my bank), it would still go through, despite your stoppage request, as it is like paper check.
So to be absolutely certain, you should stop them individually if you want to stop payment on the 2nd set of application too.
Looks like you are indeed very lucky to have got things in order despite your attorney's best efforts to screw up!

yes, now we should all start calling uscis - atleast 10 times a day, open SRs, take 4-5 infopass appointments and maybe consider going to NSC or TSC in person to see if we can talk to the IO (or have a cup of tea with the IO) to expedite our respective cases.
Who knows, if we do such things, we mite get our GCs faster than ppl already waiting ahead of us in the queue. :)
I wud also take this oppurtunity to invite more EB3 ppl to convert to EB2 now....this way, u cud get a EB-2 PD back in time, when u were not qualified for EB2. And with all desi body shops, getting this done is a piece of cake, i would assume.
Now boot me from the forums or give me all those red marks - i don't care. I wrote what was on my mind.
